These terms govern your use of the Kerb Technology platform and website. By creating an account or using our services, you agree to these terms.
1. About Kerb
Kerb Technology provides a board management platform for estate agents. The platform enables agents to generate dynamic QR-coded boards, link each board to one of their property listings, present scanning buyers with a Kerb-hosted property page (showing photos, listing details, and the agent's contact information), capture buyer enquiries through that page on behalf of the agent, redirect through to the agent's own listing where the buyer chooses, and track scan and enquiry analytics.
2. Account Registration
- You must be at least 18 years old to create an account
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorised use of your account
- One account per agency branch is recommended
3. Acceptable Use
You agree to use Kerb only for legitimate estate agency purposes. You must not:
- Upload false, misleading, or fraudulent property information
- Use the platform to collect personal data for purposes other than responding to genuine property enquiries
- Attempt to access other users' accounts or data
- Use automated scripts or bots to interact with the platform
- Resell or redistribute access to the platform without our written consent
4. Property Listings
- You are solely responsible for the accuracy of property information you upload
- Property listings must comply with the Consumer Protection from Unfair Trading Regulations 2008 and the Business Protection from Misleading Marketing Regulations 2008
- You must remove or update listings when properties are sold, withdrawn, or details change
- We reserve the right to remove listings that violate these terms
5. Scan Analytics, Property Pages & Buyer Enquiries
- When a buyer scans a QR code, Kerb records anonymised analytics (timestamp, country/city level geo derived at scan-time without storing the IP, device type from the browser user agent) and presents them with a Kerb-hosted property page that displays the listing details, photos, and your contact information. Kerb does not use device fingerprinting or any persistent identifier that would track an individual across visits.
- From that page the buyer can either click through to your own listing URL or submit an enquiry to you through Kerb.
- Where a buyer submits the enquiry form, Kerb captures their name, email address, optional phone number and optional free-text message, and stores the enquiry against your account so you can review and respond. Full details of what is collected and the lawful basis are set out in our Privacy Policy.
- You become joint controller for any enquiry submitted via your boards and are responsible for following up under your own privacy notice and for compliance with UK GDPR and the Data Protection Act 2018. The essence of the joint controller arrangement (Article 26 UK GDPR) is: Kerb is responsible for capturing the enquiry on the property page and transmitting it to you; you are responsible for all substantive follow-up communication with the buyer and any downstream processing.
- Buyers who do not submit the enquiry form remain anonymous to Kerb beyond the analytics data above.
6. Plans & Pricing
- Current plans and pricing are displayed at kerb.technology/pricing
- We may change pricing with 30 days' notice to existing users
- Free trial terms may be modified with 30 days' notice
- Free trial → paid conversion: If you elect to take a paid plan, your free trial will automatically convert to that paid plan at the end of the trial period and your card will be charged via Stripe.
- Cancellation: You can cancel your paid plan at any time from the Stripe customer portal — open it from the "Manage Billing" button on the Billing page in your Kerb dashboard. If you'd rather email us, write to connect@kerb.technology and we'll process it for you. Cancellation takes effect at the end of the current billing term — you retain access until that date.
- Refunds: Subscription fees are non-refundable. Cancelling part-way through a billing term does not entitle you to a partial refund.
7. Intellectual Property
- The Kerb platform, branding, and technology are owned by Kerb Technology
- Property content (photos, descriptions) uploaded by agents remains their intellectual property
- By uploading content, you grant us a licence to display it on property landing pages
8. Availability & Support
- We aim for high platform availability but do not guarantee uninterrupted service. Specific uptime targets, where offered, will be set out in a separate written agreement.
- Scheduled maintenance will be communicated in advance where possible

9. Limitation of Liability
To the maximum extent permitted by law:
- Kerb is provided "as is" without warranties of any kind
- We are not liable for any indirect, consequential, or incidental losses arising from use of the platform
- Our total liability is limited to the amount you have paid us in the 12 months preceding the claim
- We are not responsible for the accuracy of property information uploaded by agents
10. Account Termination
- You may close your account at any time by contacting us
- We may suspend or terminate accounts that violate these terms
- Upon termination, your data will be deleted in accordance with our Privacy Policy
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
We may update these terms from time to time. Changes will be posted on this page. Continued use of the platform after changes constitutes acceptance of the updated terms.
